These terms

By using our site and placing an order you agree to the terms on this page. If you do not agree with them, please do not order, and tell us why so we can fix it.

We may update these terms from time to time. The version that applies to your order is the one published when you placed it.

About us

IKIMSOFT is an independent online retailer of outdoor living products, operated from Guelmim, Morocco. We are not the manufacturer of the products we sell. Where we refer to a warranty, that is our own commitment to you rather than a manufacturer's contract.

Some products are fulfilled by a distribution partner inside the United States. Your contract is with IKIMSOFT, not with the partner or the manufacturer, and we are the people responsible for it.

Orders and acceptance

Placing an order is an offer to buy. A contract forms when we send you a dispatch confirmation, not when you click pay. We may decline an order, for example where an item is out of stock, where a price or description was listed in obvious error, or where we cannot ship to your address. If we decline after you have paid, we refund you in full.

Prices and payment

Prices are shown in US dollars and exclude sales tax, which is calculated at checkout and shown before you pay. If an item is listed at a price that is obviously wrong, we will contact you before charging you, and you can cancel for a full refund.

We accept PayPal and major credit and debit cards. Payment is taken when your order is placed. Full card details are handled by our payment provider and are never stored on our systems.

Delivery

Orders ship from fulfilment warehouses inside the United States. Most parcels arrive within 3 to 7 business days of dispatch. Processing time before dispatch is separate from that window, and is set out in our shipping policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Title passes on delivery unless the law says otherwise.

Returns and your statutory rights

You have 30 days from delivery to return an unused item. We set out exactly how that works, who pays return postage and when a refund is issued in our returns and refunds policy, which forms part of these terms. Please read it before you order.

Nothing in these terms limits your statutory rights as a consumer. Where you have a legal right stronger than what we have offered here, your legal right applies.

Acceptable use

You agree not to use the site to break the law, to infringe anyone's rights, to scrape or overload the site, or to place an order you do not intend to pay for. We may refuse service to anyone who does.

Product information and colours

We aim to describe every item accurately, including its dimensions and materials. Screens differ, and outdoor furniture moves in daylight, so the colour you see on your screen is a guide rather than a guarantee. If a measurement matters to whether something fits your space, our measurement guide covers how to check it properly, and we would always rather you measured than guessed.

Liability

We do not exclude or limit liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Subject to that, we are not liable for indirect or consequential loss, and our total liability in connection with an order is limited to the amount you paid for that order.

Events outside our control

We are not liable for failures caused by things outside our reasonable control, such as carrier delays, carrier damage we did not cause, industrial action, or a service interruption we did not cause. Where such a thing delays your order we will tell you, and you can cancel for a full refund if you would rather not wait.

Intellectual property

The site design, text, photographs and product images belong to IKIMSOFT or to the manufacturers who supplied them, and you may not reproduce them commercially without permission. You may link to the site and share our pages on social media as you like.

Changes and termination

We may change the site, these terms, or stop trading at any time. If we stop trading we will honour orders already placed and refund anything not shipped. We may close an account that we reasonably believe is being used fraudulently or to cause harm to us or to another customer.

Governing law

These terms are governed by the laws of the Kingdom of Morocco, and the courts of Morocco have jurisdiction. This does not affect any mandatory consumer protection available to you where you live.
